The chapter begins with a brief introduction to critical race theory which looks at how societal racism shaped civil procedure principles, particularly who has access and what pleadings are required in order to gain access. Access to the courts is an important part of securing rights for those marginalized by the law. The Chapter begins with the Dred Scott decision and ends with a 21st century access question which is designed to show that access questions for those not privileged remain. The chapter has a selection of cases and law review articles discussing the cases which provide additional information that allow for a fuller discussion of the role of racism in the case. After each set of readings there are questions and notes.
